I. WICHTIGE SICHERHEITSHINWEISE
Das Uepaa App (die „App“) ist eine Zusatzfunktion, welche in einer Notsituation dazu beitragen kann, dass die Rettungskräfte früher benachrichtigt werden und den Nutzer schneller finden können. Diese Zusatzfunktion ersetzt daher in keiner Weise die herkömmlichen Sicherheitsmassnahmen!
Folgende Sicherheitshinweise sind insbesondere zu beachten:
Einhaltung von Sicherheitsmassnahmen weiterhin erforderlich
Uepaa AG kann nicht garantieren, dass durch die App in jeder Notsituation ein Notruf ausgesendet und der Nutzer lokalisiert werden kann. Die für die jeweilige Aktivität erforderlichen Sicherheitsmassnahmen müssen daher weiterhin vollständig eingehalten werden. Das Uepaa App kann z.B. nicht die sorgfältige Planung und Vorbereitung einer Unternehmung, angemessenes Training oder geeignete Ausrüstung ersetzen. Ebenfalls ersetzt die App unter keinen Umständen eine Begleitperson.
Bestehende Funktionsfähigkeit des Smartphone erforderlich
Die Übertragung der Signale an den Server setzt die Funktionstüchtigkeit des eigenen Smartphones voraus. Die Funktionstüchtigkeit des Smartphones kann aus verschiedenen Gründen beeinträchtigt sein, z.B. durch eine manuelle Beschädigung des Smartphones, durch grosse Kälte oder Hitze, durch Nässe. Ausserdem muss der Akku des Smartphones geladen sein. Überprüfen Sie die Funktionsfähigkeit Ihres Smartphones und die Aktivierung von WLAN, bevor Sie Ihre Aktivität beginnen und schützen Sie Ihr Smartphone z.B. durch Verwendung einer Smartphone-Hülle.
Andere Smartphones mit Uepaa App in Reichweite erforderlich
Die Alarmierung über Uepaa Net setzt voraus, dass sich andere Smartphones mit einem laufenden App in Reichweite befinden oder in diesen Bereich kommen. Z.B. in sehr abgelegenen Gebieten funktioniert die Übermittlung des Notrufs über das Uepaa Net daher möglicherweise nicht und Sie können keine Notrufe aussenden noch können Sie vollständig geortet werden. Geben Sie die von Ihnen geplante Route Ihrer Aktivität einer Drittperson bekannt.
Fehlfunktion der Software
Programmierungsfehler der Software der App können nicht vollständig ausgeschlossen werden. Insbesondere können Programmierungsfehler bei der Weiterentwicklung der App auftreten. Ausserdem kann eine Beeinträchtigung der Software durch Viren oder Hackereingriffe ebenfalls nicht ausgeschlossen werden. Auch auf diese Weise kann die Funktionsweise der App im Einzelfall eingeschränkt sein.
Kompatibilität mit Smartphone erforderlich
Die Uepaa AG bemüht sich im Sinne des „Best Effort-Prinzips“, die Möglichkeiten kommerziell erhältlicher Smartphones auszuschöpfen. Jedoch ist es Uepaa AG nicht möglich, alle Komponenten und die vollständige Hardware und Software aller auf dem Markt erhältlichen Smartphones zu kennen. Insbesondere kann es sein, dass bei einer neuen Version eines Smartphones Komponenten entfernt und die Hardware oder Software verändert worden ist. Uepaa AG kann daher nicht garantieren, dass die App mit jedem Smartphone kompatibel ist. Fehlende Kompatibilität kann dazu führen, dass die App nur eingeschränkt oder gar nicht funktionsfähig ist. Fehlende Kompatibilität kann aber auch die Funktionsfähigkeit anderer Funktionen des Smartphones beeinträchtigen.
Keine Garantie auf Auslösung eines Notrufs im Rahmen der Kameradenhilfe
Im Rahmen der Kameradenhilfe wird nur ein Notruf an den Uepaa Partner abgeschickt, wenn die Notsituation entweder von Ihnen oder von einem anderen Nutzer der Uepaa App oder von der von Ihnen autorisierten Drittperson bestätigt wird. Ohne Bestätigung erfolgt kein Notruf. Stellen Sie sicher, dass die von Ihnen autorisierte Drittperson von Ihnen ausreichend instruiert und erreichbar ist, um allenfalls entscheiden zu können, ob ein Notruf ausgesendet werden soll.
Keine Garantie auf Durchführung eines Rettungseinsatzes
Auch nach Alarmierung des Uepaa Partners besteht keine Garantie, dass ein Rettungseinsatz tatsächlich oder rechtzeitig stattfinden kann. Ein Rettungseinsatz kann z.B. durch die Wetterbedingungen, die geographische Lage des Unfallortes oder durch die Bindung sämtlicher Rettungskapazitäten durch einen anderen Unfall verzögert oder sogar verunmöglicht werden. Über die Durchführung des Rettungseinsatzes entscheidet der Uepaa Partner. Ein Rettungseinsatz kann auch nur dort stattfinden, wo es einen Uepaa Partner hat.

Emergency calls: The user can use the app to send an emergency call to a Uepaa partner. The emergency call also contains data that allows the user to be located and identified. The emergency call is sent via the mobile network to Uepaa and after integration of the emergency contacts, to their partners.Location: The app sends data at regular intervals via the mobile network to the server with the information about the respective location of the user. This supports the location of the user by the emergency services. If localization is not possible because the user is not within the range of a mobile network, the rescue forces receive the data about the last localization of the user and can restrict the search accordingly.Comrade assistance: The app registers certain conspicuous changes that may indicate an accident event. The app then asks the user whether an emergency call should be sent out. If the app does not receive any feedback from the user, it reports the possible emergency situation to other Uepaa app users within range. These are asked to check whether an emergency situation actually exists and, if so, to trigger an emergency call. Without confirmation of the emergency situation by the user, another app user or a third person, no rescue will be initiated.The exact functionality of the app can be found in the description in the app store where the user purchased the app. The description of the functioning of the App in the App Store or elsewhere does not in any way constitute a guarantee or warranty statement.
C. Acknowledgement by the user

Furthermore, the user acknowledges that Uepaa AG is in no way responsible for the services of the Uepaa partners. In particular, Uepaa AG is not responsible for the fact that a rescue operation is actually carried out by the Uepaa partner. The Uepaa partner provides its services independently from Uepaa AG and does not represent an auxiliary person of Uepaa. Therefore, Uepaa AG is also not obliged to check or supervise the Uepaa partner and its rendered services or to instruct the Uepaa partner.
D. Disclaimer of warranty and liability
Thewarranty for this App and the services related to it (in particular, but not exclusively, the functionality of the App described under B) as well as for any other limitations of the functionality of the App that impair or render impossible the assumed use of the App is completely excluded.In particular, Uepaa AG also assumes no warranty that the Uepaa Partner will actually carry out a rescue operation after receiving an emergency call.The warranty of title with regard to the non-infringement of third party rights is completely excluded. To the extent permitted by law, the liability of Uepaa AG for any damage (e.g. direct and indirect, personal injury, property damage and financial loss) caused by the app, its use or the disclosure of data to Uepaa AG or third parties or otherwise in connection with the app to the user or third parties associated with the user is completely excluded. In particular, Uepaa AG is also not liable if the app impairs the functionality of the software or other apps and the user suffers damage as a result.The exclusion of liability also applies to third parties to whom the app has been made available in violation of these terms of use.This exclusion of warranty and liability also applies to the employees and bodies of Uepaa AG and to the Uepaa partners as well as other users of the app.This exclusion of liability also includes non-contractual liability facts.
E. Cost of the rescue operation
Theuser agrees to bear the costs of a rescue operation which has been triggered by his emergency call or by the emergency call within the scope of comrade assistance or by a third person, in accordance with the terms and conditions of the Uepaa partner or other rescue organization providing or attempting to provide assistance.This obligation of the user to bear the costs also applies if the emergency call has been triggered by or because of a third person to whom the user has given this app in violation of these terms of use.F. If reconfirmation is not possible, the emergency contacts selected by the user are contacted. The user acknowledges that neither Uepaa AG nor the other users of the app assume a guarantor position towards him. Neither Uepaa AG nor the other users of the app are obliged to check the notification through the app that the user may be in distress and to send an emergency call. In particular, it is possible that the other users of the App do not take note of the notification of the App regarding a possible emergency situation of the User in time or are not able to clarify whether an emergency situation exists.
G. Unauthorized use of the app
Theuser undertakes to use this app only for purposes that do not violate these terms of use or applicable law or infringe the rights of third parties.The user undertakes to make an emergency call only in an emergency situation and to ensure that third parties (especially children) do not send an unfounded emergency call.The user agrees to use this app exclusively himself and not to make it available to third parties.As far as the user violates these terms of use or applicable law, the user is obligated to fully indemnify Uepaa AG from any claims of third parties (including the assumption of attorney's fees and court costs).
H. Applicable law and place of jurisdiction
Swisslaw is applicable to this app and its terms of use. For disputes arising from or in connection with these Terms of Use or with the App, the courts at the registered office of Uepaa AG shall have jurisdiction.
I.Amendment of the Terms of Use
UepaaAG is authorized to unilaterally amend these Terms of Use at any time without the user's consent. In this case, the user will be informed about the change of the terms of use via the app and has to accept it before the app can be used again. Otherwise Uepaa AG is entitled to terminate the contract without compensation and with immediate effect. A discontinuation of the service on the part of Uepaa AG is equated to a termination in this case. The further use of this app after such a change is also considered as consent to the change.
J. Final provisions
Ifindividual provisions of the Terms of Use are or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In this case, the parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the economic purpose of the invalid provision. The same applies to loopholes in these terms of use. In particular, the terms of use, license and data protection conditions of the app store where the user purchased the app can be applied analogously for this purpose. The user declares that he/she has taken note of the safety instructions and has read and understood the terms of use and the privacy policy and agrees to them by clicking on "Accept". Use of the app and the associated services shall in any case be deemed to constitute acceptance of these Terms of Use and the Privacy Policy.
